Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and the proprietor of cyfare.net ("CYFARE", "we", "us", "our"), an individual sole proprietor operating in India under the trade name "CYFARE". The business is not a body corporate; it is not registered under the Companies Act, 2013, and all rights, obligations and liabilities under these Terms vest in the proprietor personally. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and are enforceable as a contract under the Indian Contract Act, 1872.

1. Acceptance of Terms

By accessing, browsing, registering on, or purchasing from cyfare.net (the "Platform"), including its threat-intelligence APIs, vulnerability/exploit databases, malware scanning tools, free software tools, the S32 platform and the shop, you confirm that you have read, understood and agree to be bound by these Terms, the Privacy Policy, the Acceptable Use Policy, and — where applicable — the S32 Restricted Platform Terms and the Refund & Cancellation Policy (together, the "Agreement"). If you do not agree, you must discontinue use immediately.

2. Eligibility

You must be at least 18 years of age and competent to contract within the meaning of Section 11 of the Indian Contract Act, 1872. The Platform is not intended for minors, persons of unsound mind, or persons disqualified from contracting under any applicable law. Access to the S32 platform is additionally restricted as described in the S32 Restricted Platform Terms.

3. Description of Services

CYFARE provides, inter alia:

All intelligence, data and tools are provided for lawful, defensive and research purposes only.

4. Accounts, API Keys & Security

You are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity occurring under them. You must notify us immediately at legal@cyfare.net of any unauthorized use. We may suspend or terminate access for breach of these Terms, suspected fraud, abuse, or where required by law or lawful order of a court or government authority.

5. Intellectual Property

The Platform, including its software, databases, compilations, designs, trademarks, trade names and content, is the exclusive property of the proprietor of CYFARE and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws. Subject to these Terms we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. No ownership rights are transferred. You may not scrape, mirror, resell, sublicense or create derivative databases from Platform content without prior written consent, except where an API subscription expressly permits integration.

6. Acceptable Use

Use of the Platform is subject to the Acceptable Use Policy, which forms part of these Terms. Any unlawful, offensive or unauthorized use — including unauthorized access, testing or attack against systems you do not own or lack written authorization to test — is strictly prohibited and may result in termination and referral to law-enforcement authorities.

7. S32 Restricted Platform

The S32 identity-intelligence platform is a restricted service offered exclusively to verified personnel of Indian law-enforcement agencies and other government bodies expressly authorized under Indian law. Access is subject to identity and authority verification, and to the S32 Restricted Platform Terms. No access is offered to private individuals, private investigators, foreign entities or unauthorized persons.

8. Shop, Partner Sales & Defense Products

Products listed in the CYFARE shop — including defense accessories, security gadgets, machines, parts and raw materials — are offered in partnership with third-party sellers, registered middlemen and licensed shops. For any product whose manufacture, possession, transfer or sale is regulated under the Arms Act, 1959, the Arms Rules, 2016, or any other applicable law:

Nothing on the Platform constitutes an offer to sell any item to a person not legally entitled to acquire or possess it, nor any offer of export. Regulated items are supplied strictly within India in accordance with applicable law; no regulated item is exported without the authorizations required under the Foreign Trade (Development and Regulation) Act, 1992 and the WMD Act, 2005 (SCOMET), where applicable.

9. Payments & Taxes

Prices are listed in Indian Rupees (INR) unless stated otherwise and are payable through the payment methods displayed at checkout (including UPI). For digital services and API subscriptions sold directly by CYFARE, receipts are issued in the proprietor's name and the proprietor's business income is assessed to tax as individual income under the Income-tax Act, 1961. For partner-sold products, invoices and applicable taxes (including GST, where the partner is registered) are the responsibility of the partner seller. Statutory taxes, if applicable to a sale, will be shown or communicated at or before payment.

10. Disclaimers

The Platform and all data, intelligence, tools and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CYFARE disclaims all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Threat intelligence, vulnerability data, scan results and S32 outputs are probabilistic, may contain errors or omissions, and must be independently verified before being relied upon for any operational, investigative or legal purpose. CYFARE does not warrant uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CYFARE (and its proprietor) shall not be liable for any indirect, incidental, special, consequential or punitive damages, loss of profits, data, goodwill or business opportunity, arising out of or relating to the Platform. The aggregate liability of CYFARE for any claim arising from a paid service shall not exceed the amount actually paid by you to CYFARE for that service in the three (3) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under Indian law.

12. Indemnity

You agree to indemnify and hold harmless CYFARE and its proprietor from and against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, your violation of any law or the rights of any third party, or any action taken by you using data, tools or outputs obtained from the Platform.

13. Third-Party Links & Services

The Platform may link to third-party websites, marketplaces (including RapidAPI) and partner sellers. CYFARE does not control and is not responsible for third-party content, policies or practices. Dealings with third parties are solely between you and the third party.

14. Termination

We may suspend or terminate your access at any time for breach of these Terms or where required by law, without prejudice to accrued rights. Upon termination, your licence to use the Platform ceases immediately. Provisions which by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) survive termination.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at [City, State], India shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms or the Platform.

16. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Grievance Officer for the Platform may be contacted at legal@cyfare.net. Grievances are acknowledged within 24 hours and resolved within 15 days.

17. General

We may update these Terms from time to time; the revised version takes effect upon publication on this page. If any provision is held invalid or unenforceable, the remainder continues in full force. Failure to enforce any provision is not a waiver. These Terms, together with the other documents in the Legal Center, constitute the entire agreement between you and CYFARE regarding the Platform.
